UNA MEMBER BRIEFING: UNA Town Hall Meeting on Executive Actions

Join your fellow nonprofit members, UNA, and Jessica Mendieta, Policy Associate with the National Council of Nonprofits (NCN), for a virtual Town Hall on Executive Actions. We will provide an update on recent federal executive actions, legal challenges to the actions, and steps nonprofits can take now to prepare for changes and Jessica will update us on NCN's response to recent Executive Orders. - Breaking News: The original OMB Memorandum M-25-13 is rescinded.
- UPDATE | 1:00 pm MT: Conflicting statements have come from the White House Press Secretary. Stay tuned for the latest.
- UPDATE | 4:00 pm MT: For now, rescinding M-25-13 means that the federal grant and contract process, including the disbursement of federal funds to nonprofits, should continue for the time being.
- The original memo would have required all federal agencies to pause issuing new grant awards, disbursement of funds under existing grants, and other relevant agency actions related to their grant programs. It also would have required agencies to review their grant programs and report to OMB by February 10 on grants that are inconsistent with President Trump’s Executive Orders.
- On Tuesday, January 28, a federal judge issued an administrative stay minutes before the original memo was set to take effect delaying the implementation of parts of the memo until at least Monday, February 3 at 5 p.m. That administrative stay is now moot since the original memo has been rescinded.

Summary of Executive Actions and Nonprofit Resources

On Jan. 27, 2025, the Office of Management of Budget (OMB) issued an memo in response to some of the executive orders, including Executive Order Ending Illegal Discrimination and Restoring Merit-Based Opportunity, that called for the pausing of all OMB grants and loans. The National Council of Nonprofits, American Public Health Association, Main Street Alliance, and SAGE filed for a temporary restraining order to stop the memo from going into effect (see the Complaint). On Jan. 28, 2025, minutes before the memo went into effect, a DC federal judge ordered an administrative stay, which temporarily blocks the freeze until Feb. 3, 2025, at 5:00 pm Eastern. A separate suit by 22 state Attorneys General was also filed in federal court.
On January 29, the original OMB memo was rescinded, however conflicting statements have come from the White House Press Secretary. Stay tuned for the latest.
What Utah Nonprofits Can Do
Don’t Panic: Many people are working to make sure nonprofits’ voices are heard, including our colleagues at the National Council of Nonprofits. You’re not in this alone—the nonprofit community is rallying to make sure people like you have advocates.
Be Prepared
Let Us Know the Impact: Please fill out this National Council of Nonprofits Survey so that we can track potential impacts of this federal action. Or send us an email. The aggregate impact will be reported to congressional offices, funding partners, and our national networks so that a full picture can be provided. Names of organizations and contacts will remain anonymous unless permission is explicitly granted to share.
Assess Your Funding: Right now, UNA recommends organizations who receive federal funding, have been awarded federal funding, have applied for federal funding, or were considering applying for federal funding, to assess the program(s) which they were participating in and the projects in any grant or loan request, and conduct a staff-level review of how this policy may impact you. This includes taking the following steps:
- Identify any federal funding in your organization's orbit.
- Any funding your organization receives directly or indirectly (awarded).
- Any projects/programs you anticipate/hope will be funded by the federal government (applied or contemplating).
- Detail the types of federal funds - formula-based, competitive grant, loan.
- Detail the type of federal program - regional/national, urban/rural, population-based, targeted programs, etc.
- If the program is in statute, try and find that language.
- Review current Executive Orders.
- Specifically, additional guidance on January 28 included these EOs:
- Enforcing the Hyde Amendment
- Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government
- Ending Radical and Wasteful Government DEI Programs and Preferencing
- Unleashing American Energy
- Putting America First in International Environmental Agreements
- Reevaluating and Realigning United States Foreign Aid
- Protecting the American People Against Invasion
- Specifically, additional guidance on January 28 included these EOs:
- Assess if any of your federally-funded (or potentially federally-funded) projects/programs can be considered under the umbrella of any Executive Order. Specifically look at those mentioned in the Memo.
- Our advice - lean on the broadest interpretation for now.
- State Funding Flag: We recommend taking stock of your state funding as well since many state programs receive funds through federal sources. It is unclear (as of this writing) if/how state funding is impacted, particularly when it trickles down to nonprofits.
- All nonprofits should:
- Create an updated budget and financial forecast that reflects the potential loss of these funds.
- Map out scenarios for worst-case, moderate, and best-case (but still conservative) outcomes.
- Determine the mission-critical activities that must continue to fulfill the organization’s core purpose.
- Identify non-essential costs that you can reduce or defer to protect core services.
- Notify your board and give them your latest financial information and forecast/planning documents. Consider creating a dedicated subcommittee for responding to executive actions. Ask them to raise awareness.

Urgent Update Regarding Today’s Federal Funding Freeze

Dear UNA Community,
Last night, the Trump administration announced an immediate freeze on all federal grants and loans beginning at 5pm today, January 28. This action will directly affect Utah’s nonprofits and the communities they serve, impacting education, health care, housing aid, disaster relief, and more—programs reliant on significant federal funding. Indirectly, the implications of cutting funding to programs that serve our most vulnerable will be profound.
The memo issued by the Office of Management and Budget announced that funds will be temporarily frozen as the administration evaluates grants and loans to confirm their alignment with the president's agenda. This includes recent executive orders aimed at ending diversity, equity, and inclusion (DEI) initiatives.
Many federal grants, loans, and payments will be in jeopardy, although the memo specifies that Social Security, Medicare, and “payments to individuals” will not be touched. Federal agencies have been tasked with completing a review of spending to ensure alignment with the Administration’s priorities, and officials have until February 10 to submit reports to OMB. The White House is planning a press briefing at 1PM Eastern/11AM Mountain Time today.
The order raises a number of constitutional issues, which no doubt will be challenged in court.
UNA is working with our public policy partners to understand the full scope of the order and its implications and will provide you with up-to-date information as it becomes available.

Executive Orders Affecting Nonprofits
After his inauguration January 20, 2025, President Trump signed dozens of Executive Orders (EOs) covering a broad range of issues, many of which could have impacts on the nonprofit community.
Issues include diversity, equity, and inclusion programs, government grants and contracts, civic engagement, immigration, and certain nonprofit subsectors.
Some of the EOs won’t take effect immediately, and many are expected to be immediately challenged in court. Thanks to National Council of Nonprofits, here’s what we know so far about those EOs that will directly or peripherally impact the charitable nonprofit sector.
Diversity, Equity, and Inclusion (DEI)
Trump rescinded dozens of EOs or memorandums issued by President Biden including most EOs related to diversity, equity, and inclusion initiatives, and those creating equity for LGBTQ+ and other historically marginalized communities. A Trump official told a group of reporters that more actions impacting DEI initiatives in the private sector may be coming soon.
Nonprofit Impact: Federal government DEI programs and trainings, often provided by or in partnership with nonprofits, will be eliminated. In addition, Trump administration officials have said that actions affecting DEI initiatives in sectors beyond the federal government are forthcoming.
Immigration
Trump signed EOs declaring a national emergency at the southern border and revoking birthright citizenship (which is very likely unconstitutional).
Nonprofit Impact: Nonprofits working with immigrant populations, providing legal assistance or training, or delivering humanitarian or other direct aid, may see the need for services increase, may lose funding, and could be targeted by law enforcement. Human services and social services could also be targeted.
Federal Government
Nonprofit Impact: Nonprofits partnering with federal government agencies or receiving federal funding, especially through government grants and contracts, may experience longer wait times and slower processing, loss of points of contacts or difficulty reaching them, and increased strain on relationships.
Nonprofits should advocate for and talk to government partners about government grants and contracting reform and provide specific examples of how processes and reporting requirements
could be streamlined.
Nonprofits will no longer have direct White House connections through the Office of Faith-Based and
Neighborhood Partnerships.
Census and Civic Engagement
Trump also rescinded Executive Order 13986: Ensuring a Lawful and Accurate Enumeration and Apportionment Pursuant to the Decennial Census. The previous Order required all persons, regardless of citizenship or immigration status, to be counted in the Census. This new EO lays the groundwork for legislation and other actions to not include noncitizens in the count.
Nonprofit Impact: Lays the groundwork for legislation and other actions to exclude noncitizens from future Censuses. The National Council of Nonprofits submitted an amicus brief when this issue was heard by the U.S. Supreme Court for the 2020 Census.
Other
Nonprofit Impact: Nonprofits working on specific issues and from various subsectors seen as providing information contrary to the Administration may be targeted.
Arts and culture nonprofits, museums, and libraries will no longer be “integrated into strategies, policies, and programs that advance the economic development, well-being, and resilience of all communities,” among other things, by the Trump Administration.
Nonprofits that provide foreign assistance may be targeted.
This is just the beginning of a wave of actions by the Trump administration, and we expect many more EOs and official actions in the coming days and weeks.
UNA and our partners at the National Council of Nonprofits are monitoring all executive actions (and congressional legislation) that can impact the nonprofit sector, and we’ll share updates and needed action as we have them.
