Department of Labor Salary Threshold Update
On November 15, a federal judge in Texas struck down the U.S. Department of Labor’s (DOL) latest attempt to raise the minimum salary thresholds for the Fair Labor Standards Act’s (FLSA) white-collar overtime exemption, finding that the rule exceeded the agency’s statutory authority. The ruling stops the salary increase to $1,128 per week set to take effect on January 1, 2025, and further invalidates the prior increase that went into effect on July 1, 2024, as well as the rule’s automatic triennial salary level adjustments included in the DOL’s April 2024 overtime rule.
